On occasion, we may need to alter our Terms & Conditions. FEELING SALTY reserves the right to update and change the Terms & Conditions without notice, by amending, adding or subtracting information from this page. We do suggest that you read over this regularly to become familiar with our agreement before placing an order with us to ensure you are aware of our most up to date Terms & Conditions.
1. Disclaimer of Liability
1.1. You are responsible for reading our Terms and Conditions prior to placing your order with us. FEELING SALTY holds no liability outside of our Terms and Conditions & Company Policy.
1.2. FEELING SALTY will not provide any warranty, either express or implied relating to our website in respect of the accuracy, completeness, fitness for purpose or legality of any information accessed using this Site; subject to any rights you have under any consumer protection law or any other laws that cannot be excluded.
1.3. At FEELING SALTY, we take the utmost care in the functionality of our site and ensuring that our site is free of any virus. However, we are not liable for any damage to your computer system(s) and all electronic devices, should this be connected to our website or any linked website.
2.1. The FEELING SALTY website and content (without limitation to; all written material, imagery, videography & audio) are exclusive property of FEELING SALTY and are protected by copyright, trademark, trade dress & other laws, unless otherwise stated.
2.2. FEELING SALTY is an Australian based fashion house and all products & services displayed within the site are in Australian Dollars (AUD) unless otherwise stated.
3.1. FEELING SALTY will not dispatch any online orders until payment has been received and processed. Any orders pending payment will automatically be cancelled within 30 days if no payment has been processed. It is your responsibility to ensure you have the available funds prior to placing an order.
4. Data Protection
5.1. Once order has been placed with FEELING SALTY, an order confirmation email will be automatically sent to the email address registered. This email is only an acknowledgement and will not constitute as acceptance of your order. Please add the FEELING SALTY email in your contact address book to ensure our emails are not directed to your spam/junk mail or blocked by your fire wall.
6.1. At FEELING SALTY we strive to provide you with accurate product descriptions and images that reflect our products accurately. Images are provided for illustrative purposes and we can not guarantee an accurate representation of the colours reflected. In the instance that information provided in the product description may be inaccurate, we reserve the right to correct and amend any error or omission. FEELING SALTY is not liable to provide any refunds or reimbursements for inaccurate product description and/or images.
7.1. FEELING SALTY pieces are only deemed as Faulty if the goods were received damaged or a manufacturing fault occurs within 6 months of delivery date. Items that are damaged through wear and tear are not considered as faulty: this includes pulls in fabric, items treated against the care instructions, pilling in fabric, bleach stains, sun damage or failure to take reasonable care. Any faulty items will either be replaced by the same style and size within your proof of purchase or repaired with our manufacturers back to original condition. Should FEELING SALTY fail to replace or repair your faulty item, a full refund will then be issued.
8.1. Our Site may include hyperlinks to other websites and the links are provided for convenience only. FEELING SALTY holds no responsibility for the content and maintenance of or privacy compliance by any linked website.
9.1. You agree to indemnify and hold us and our related entities, affiliates and our and their respective officers, agents, and employees - harmless from and against any and all claims, demands, proceedings, losses and damages (actual, special and consequential) of every kind and nature, known and unknown, including reasonable, legal fees, made by any third party due to or arising out of your breach of these Terms and Conditions or your breach of any law or the rights of a third party.
Affiliates: a person or organisation official attached to a larger body or enterprise.
Business Day: a day which is not a Saturday, Sunday or a public holiday in NSW Australia.
Consequential: also referred to as special damages; are damages that can be proven to have occured because of the failure of one party to meet a contractual obligation.
Content: the things and materials that are held or included within FEELING SALTY.
